Part-time employees covered by the Employment Act are legally entitled to paid annual leave as long as they have completed at least 3 months of service.

  • How it is calculated: Leave is pro-rated based on how many hours they work compared to a full-time employee in a similar role. Under MOM regulations, part-time annual leave is tracked in hours rather than days to ensure accuracy.

3. Pro-Rated Sick and Hospitalisation Leave

Just like annual leave, part-time staff who have worked for at least 3 months are entitled to paid sick leave. They must inform their employer within 48 hours and provide a valid Medical Certificate (MC). Furthermore, employers are mandated to reimburse the medical consultation fees for part-time staff if they are granted at least one day of paid sick leave from an approved clinic.

4. Overtime Pay

Just because someone is part-time does not exempt them from overtime protections. Part-time workers qualify for overtime pay when they exceed their contractual daily working hours.

  • If they work more than their contracted hours, but less than a full-time employee’s normal hours, they are paid at their regular basic hourly rate.

  • If their hours exceed those of a standard full-time employee (e.g., more than 44 hours a week), the overtime rate legally jumps to 1.5 times their basic hourly rate.

5. Public Holiday Pay

Part-time employees are entitled to public holiday pay. This is pro-rated based on their annual working hours compared to a full-timer. Alternatively, employers and employees can agree to encash public holidays and simply add a small, calculated percentage to the employee’s hourly gross rate of pay.
